Compliance Update: Hawaii Criminal Record Lookback

On September 15, 2020, Hawaii Governor David Y. Ige signed Senate Bill 2193 HD2, which narrows the scope of convictions that employers can use for hiring and other employment-related decisions. BIS strongly encourages that you consult with an attorney or your legal department to determine how to adjust your hiring practices in accordance with the amended law. Item of note in this bill:
  • Criminal history lookback has been reduced from ten (10) years. Employers in Hawaii now may only consider felony convictions that occurred in the last seven (7) years and misdemeanor convictions that occurred in the last five (5) years (both excluding any periods of incarceration).
